erms and Conditions
This agreement outlines the terms under which the apartment providing the services specified in the booking form (“Accommodation”) is offered to you. This agreement is entered into between the signatory (“You”) and the operator of the apartment, Angéla Szilvási (7627 Pécs, Bittner Alajos u. 48., 183089SE).
Booking Confirmation
To confirm your booking at OceanFront Elegance Madeira Retreat, a deposit of 30% of the total amount is required. This amount is refundable if you notify us more than 14 days prior to arrival that the booking is no longer needed.
For bookings made less than 14 days before arrival, full payment is required at the time of booking. No refunds are available for cancellations within this period.
The full payment must be received in the accommodation’s bank account no later than the day of arrival. Please note that bank transfers between Hungarian and Portuguese accounts may take up to 3 business days.
If payment is not received by OceanFront Elegance Madeira Retreat within the specified timeframe, Lucas Holiday Rentals reserves the right to cancel the booking, and any paid amounts will be forfeited.
Payment Method
OceanFront Elegance Madeira Retreat accepts the following payment method:
Bank transfer in euros. Bank details are available upon request.
Extension of Stay
Should you wish to extend your stay, it can be accommodated if availability allows. The fee for the extension must be paid immediately. If not paid, cleaning will be scheduled for the originally agreed check-out date.
Accommodation Use
This agreement grants you the right to occupy the Accommodation only. No other express or implied rights are granted.
Occupancy Limit
The apartment accommodates a maximum of 6 guests. If occupancy exceeds this limit, OceanFront Elegance Madeira Retreat reserves the right to charge €150 per additional person per night, or require the additional guests to vacate the property.
Responsibility
Guests must respect other residents and tenants of the building. Please keep noise levels to a minimum. If disturbances are reported due to guests or their visitors, the stay may be immediately and automatically terminated. Guests are responsible for any damage caused intentionally or through negligence. Smoking is prohibited throughout the property, and violations will result in a fine. Damages will be invoiced and must be paid within 7 business days.
Check-In and Check-Out
Guests may check in from 16:00 on the day of arrival. Check-out must be completed by 11:00 on the day of departure. A late check-out fee of €250 applies. Details regarding key collection will be provided prior to check-in.
Early Departure
If guests leave before the agreed departure date, OceanFront Elegance Madeira Retreat will consider this an early termination and proceed with final cleaning.
Inventory / Property Damage
Any damage beyond the security deposit amount must be reimbursed by the guest within 7 days of receiving the invoice from OceanFront Elegance Madeira Retreat. Failure to do so may result in legal action. All interest, legal fees, and collection costs will be charged to the guest.
Additional Charges
Broadband Internet: Provided free of charge. Access codes are given at check-in. OceanFront Elegance Madeira Retreat is not responsible for hardware/software issues or outages caused by the service provider.
Cleaning: The property must be left in a reasonably clean condition. Additional cleaning, if deemed necessary, will be charged and must be paid within 7 days.
Smoking: Smoking is strictly prohibited in the apartment. As of July 2007, smoking in enclosed communal areas is illegal. Violation will incur a €250 fine for cleaning, ventilation, and air-conditioning services. Additional damages will be invoiced separately within 7 days.
Keys: One set of keys is provided. Additional sets are available upon request before arrival, subject to availability. Lost keys will incur a replacement fee of €100 + VAT, and €150 + VAT for garage remotes. Lock replacement costs a minimum of €100 + VAT. OceanFront Elegance Madeira Retreat may charge for additional nights if the property cannot be accessed or rented out due to missing keys.
Parking: A garage remote is provided and must be left in the apartment at departure. Failure to do so incurs a €150 replacement fee.
Call-Outs: Calls to staff between 22:00 and 09:00 for non-emergency reasons may be charged at €100 + VAT.
Liability
OceanFront Elegance Madeira Retreat is not liable for loss or damage to personal belongings, furniture, or equipment in the apartment, nor for acts or omissions of third parties. Guests are advised to ensure their own insurance covers personal property during their stay. We recommend obtaining adequate travel insurance.
The property advertised on the OceanFront Elegance Madeira Retreat website is owned by a third party. While we strive to uphold high standards, we cannot guarantee that the property meets all applicable national laws (health, safety, insurance) on your behalf. Rights and remedies under such laws may differ from those in Portugal.
This agreement excludes liability for death or personal injury or any other liability that cannot be excluded under Portuguese law.
Property Access
Outside of weekly cleaning, OceanFront Elegance Madeira Retreat staff may need to access the property. We reserve the right to enter at any time and will notify you in advance whenever possible.
Pets
Pets are not allowed at OceanFront Elegance Madeira Retreat.
Services
We are not liable for disruptions to services such as electricity or water, nor for noise, damage, or disturbances caused by repairs within the property or surrounding area.
Communication
We are available daily from 10:00 to 22:00. If you plan to arrive outside these hours, please contact us in advance during office hours to ensure everything is ready.
Charges
Depending on the booking platform, damage fees may apply. The lead guest assumes full responsibility for any damages or additional costs, and agrees to be the named party on the invoice. The lead guest must pay within 7 days, failing which 8% daily interest and collection costs apply.
If damages are found, the lead guest is fully responsible for:
Full repair cost of the damage
20% administrative fee for arranging repairs
Up to 5 nights’ rental if the property cannot be re-let
Relocation costs for guests affected by property damage
Damage Waiver
OceanFront Elegance Madeira Retreat covers accidental damage up to €500 per stay. Examples include stains, broken glass, or loose handles. This waiver does not cover intentional damage or theft, which is fully charged to the lead guest under Clause 15 of this agreement.
Entire Agreement
This agreement is governed by Portuguese law, and both parties submit to the exclusive jurisdiction of Portuguese courts. This document constitutes the entire agreement and supersedes all prior communication or agreements.
You explicitly agree that any changes to this agreement must be in writing and signed by both parties’ authorized representatives.
UNAUTHORIZED EARLY CHECK-IN MAY INCUR AN EXTRA FEE. PLEASE ENSURE YOU CHECK OUT BY 11:00 TO ALLOW FOR CLEANING.
